CONSTRUCTION DEFECTS / PROPERTY DAMAGE

Mr. Evans has handled hundreds of construction defect cases in both the residential and light commercial settings, including class actions involving defective construction products such as synthetic stucco, windows and composite siding. Evans Law represents landowners, developers, building companies, homeowners and homeowners’ associations in claims involving defective products, design defects and poor workmanship in connection with the construction of condominiums, office buildings, townhomes and large single family homes. The firm regularly works with engineers, certified industrial hygienists and other construction consultants in the defense and prosecution of such claims. Mr. Evans also deals with insurance issues related to the construction industry and has litigated, arbitrated and mediated a wide variety of such claims.

COMMERCIAL / BUSINESS LITIGATION

Business relationships invariably commence with the best of intentions. Unfortunately, reality shows us that such relationships can sour over time, and that the break up is usually fraught with highly charged and complex issues. Given this, contracts must be carefully drafted and negotiated at the outset of the relationship with an eye toward the potential for future disputes. Initial contract construction and review is therefore critical to all phases of the relationship.

Evans Law is well versed in contract construction and review, and in handling all types and aspects of commercial claims and disputes. The Firm represents individual business owners, regional and national businesses, home building companies, engineering firms, property management firms and banks in such matters. These matters include breach of contract claims, commercial collection and foreclosure claims, trademark infringement, business torts, breach of fiduciary duty claims, non-competition agreement disputes, and insurance disputes, to name a few.

The Firm has served as both in-house counsel and outside corporate counsel for several local and regional businesses, and thus understands the critical need for efficient and timely resolution of disputes. Mr. Evans typically counsels his clients to avoid litigation if possible. However, when litigation is unavoidable, he is dedicated to the aggressive, strategically focused prosecution of all claims, through trial by jury, if necessary.   Mr. Evans’ experience as both corporate counsel and a trial lawyer puts him in a unique position to achieve stellar results across a wide variety of disputes for businesses and individuals.

REAL PROPERTY LITIGATION

Over the last 30 years, Mr. Evans has advised on or litigated a broad array of real property disputes and issues. Whether it’s the family home or farm, the vacation home, tracts of developed or raw land, hunting property, timberland, or any other real estate holdings, these assets are typically the most significant in any portfolio. Litigation related to real property is often high stakes, with significant consequences. Mr. Evans has successfully handled disputes involving real property matters, including the following:

  • Boundary Line Disputes
  • Trespass/Water Runoff/Drainage
  • Timber Rights
  • Easements
  • Interpretation and Enforcement of Homeowner Association Covenants
  • Property Insurance Matters

  • Community Association Law
  • Injunctive Relief
  • Declaratory Judgment Actions

PERSONAL INJURY

Mr. Evans has been on both sides of the table in personal injury cases. Early in his career, he defended individuals, businesses, insurers, manufacturers, landowners, retail stores, large trucking companies and other entities against claims involving catastrophic injury and death. Most recently, he represents those who have been injured due to the negligence of others. Mr. Evans has tried such cases to jury verdict in state and federal courts across the SE states.

The Firm frequently forms alliances with other firms and lawyers when specialized expertise or additional support will strengthen the presentation of the client’s claims. If you would like to discuss your case with an attorney who knows both sides of the fence and who will provide a candid assessment of your case, please call Rick Evans.
